APPEAL PERIOD

After the Public Hearing, the First Amendment to the Original Development Agreement with Boulangerie La Vendeenne was approved in the Council meeting of May 26, 2020. Under the Municipal Government Act, the aggravated person may appeal the Council's decision to the Nova Scotia Utility and Review Board during the 14-day appeal period between June 3 and 17.

Please note that only on the grounds that the decision of Municipal Council does not reasonably carry out the intent of the Blockhouse Secondary Planning Strategy, you may appeal the Council decision.

The public may make formal written submissions to the Council on the Amendment. COUNCIL NOTICE OF INTENTION TO APPROVE

Council has meet on Tuesday, April 28, 2020, to conduct First Reading to amend the existing Development Agreement with Boulangerie La Vendéenne.

PLANNING ADVISORY COMMITTEE (PAC)

The Planning Advisory Committee, in session April 23, 2020, made the following recommendation to Municipal Council:

That Municipal Council approve the amendment to the existing Development Agreement with Boulangerie La Vendéenne.

BLOCKHOUSE AREA ADVISORY COMMITTEE (AAC)

Blockhouse Area Advisory Committee, at its meeting on March 9, 2020, passed a following motion:

That Blockhouse AAC recommends the Planning Advisory Committee to move forward with recommending the amendment to the existing Development Agreement with Boulangerie La Vendéenne, to the Municipal Council, subject to any conditions required by Nova Scotia Transportation and Infrastructure Renewal, Nova Scotia Environment, and the Blockhouse Fire Department to satisfy the relevant policies.

BACKGROUND

Municipality received an application from the owner of Boulangerie La Vendéenne (500 Highway 325, Blockhouse), a French bakery, to amend the existing Development Agreement for an expansion of the permitted uses and the current building. Currently, the building cannot be larger than 570 square metres (6,135 square feet), and cannot be used as anything other than a bakery (manufacturing of baked goods) and a related-retail use (selling of the baked goods).

PROPOSED CHANGES

In the last couple of years, customers expressed interest in sitting down and ordering food and drink for consumption on the premise. The owner wishes to expand on the bakery use to accommodate cafe, snack shop, pickle-and-jam production, and other mercantile uses. The owner also wishes to expand the loading and storage area (87.8 m2) and the storefront area (209 m2). The total proposed building size is expected to be 755 m2.

AMENDMENTS

To accommodate the existing and future uses, the following amendments are required:

  1. Addition of permitted uses, including:
    1. Food manufacturing;
    2. Limited-service eating places;
    3. Other specialty food stores
  2. Expansion of the maximum building footprint from 570 m2 to 800 m2;
  3. Deletion of maximum total indoor floor area for the related Retail operations; and
  4. Defining the minimum number of parking spaces required for the storefront use.
