Notice of Proposed Amendments to Cluster Development Regulations- First Reading Scheduled for April 22, 2025
Following Council’s direction on March 25, 2025, draft amendments to the Cluster Development Regulations have been prepared. The key changes are:
- Permit Window: Developers (excluding phased‐development condominiums) would have a specified period to obtain a building permit.
- Non-Conforming Status: If construction begins within 12 months of building permit issuance, the development would be deemed non-conforming and exempt from certain regulatory requirements.
- Extended Grandfathering: The cutoff date for grandfathered projects would be moved from December 31, 2025, to December 31, 2026.
- Would allow non-phased cluster developments that cannot be completed within the building permit application timeframe to enter into a development agreement prior to December 31, 2026.
Council will review and consider First Reading of these amendments on April 22, 2025, to the Municipal Planning Strategy and the Municipal-Wide Land Use Bylaw regarding cluster development regulations.
